Terms and Conditions
Cox and Kings Global Services Private Limited ("CKGS") has been appointed by the Ministry of External Affairs through the Embassy of India, Washington DC ('Mission') for providing services, to the Indian Embassy and Missions in USA, in respect of Visa applications ('Services') at the designated exclusive Visa / OCI / PIO / Renunciation service centers namely Visa Application Centers ('VACs') at Washington DC, Atlanta, Chicago, Houston, New York and San Francisco.
The following Terms & Conditions constitute the legal basis for the rendering of Services by CKGS.
For the purpose of the Terms and Conditions, the Applicant is a natural or legal person and has agreed to use the Website and/or receive the Services from CKGS. By registering on the Website the Applicant shall be presumed to have accepted this electronic version / electronic record of the Terms and Conditions and has allocated, if applicable, himself / herself a unique identification user name ("Username" and "Password").
The Terms & Conditions govern the Applicant's use of the Services and are acknowledged as having been read, understood and agreed without any limitation or qualification by the Applicant through submission of his / her complete physical applications including full payments to the CKGS Application Center. This will also form a part of the Applicant contract with CKGS.
The website www.in.ckgs.us contains the required information in connection with the Services. The said website will be updated as per the instructions of the Mission and will change from time to time.
Except where covered under CKGS Refund Policy below, all fees are non - refundable and will be retained by CKGS on payment by the Applicant even if the Applicant does not make or proceed with the application and whether or not the application is granted.
No employee of CKGS has any authority whatsoever to change, amend, amplify or withdraw any or all of these Terms and Conditions without prior written approval from CKGS.
These Terms and Conditions also contain a disclaimer which limits CKGS liability to the Refund Policy stated below.
USE OF WEBSITE
By accessing this Website the Applicant represents and warrants that they are not legally restricted from accepting the Terms and Conditions and thus executing this electronic version / electronic record forming a binding contract towards CKGS for the request and receipt of the Services.
The website www.in.ckgs.us contains the required information in connection with the Services ("Website"). The said Website will be updated as per the instructions of the Mission and will change from time to time without any notification from CKGS to the Applicant(s). The Applicant should check this page regularly to take notice of any changes that may have been made to the Terms of Service.
The Applicant shall only use this Website to request processing of the Visa / OCI / PIO / Renunciation service applications contemplated herein and shall not use this site for any other purposes, including without limitation, to make any speculative, malicious, false or fraudulent comments/applications/demands etc. The Applicant shall not make any requests in the name of fictitious person. The Applicant agrees that they will not use any device, software or routine that would interfere or be reasonably expected to interfere with the normal working of this Website. The Applicant agrees that they shall not take any action that imposes a burden or load on our infrastructure that CKGS deems in its sole discretion to be unreasonable or disproportionate to the benefits CKGS obtains from the Applicant's use of the Website. The Applicants are prohibited from posting or transmitting any unlawful, threatening, libellous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage acts or omissions that would amount to a criminal offense or attempt to commit a criminal offense, or give rise to civil liability, or otherwise violate any law. In addition, The Applicants are prohibited from posting or transmitting any information which (a) infringes the rights of others or violates their privacy or publicity rights, (b) is protected by patent, copyright, trademark or other proprietary right, unless with the express written permission of the owner of such right, (c) contains a virus, bug, worm or other harmful item or programme that may, fully or partially, damage, detrimentally interfere with, surreptitiously intercept and/or expropriate or compromise any system, data or important information, or (d) create any liability for CKGS or cause us to lose (fully or partially) the services of our ISPs or other suppliers. The Applicant shall be solely liable for any damages resulting from any infringement of copyright, trademark, or other proprietary right, or any other harm resulting from Applicant's use of this Website.
This Website may contain links to other websites ("Linked Sites") including links to the websites of the Mission, which are not operated by CKGS. Consequently, CKGS has no control over such Linked Site(s) and accepts no responsibility for them or for any loss or damage that may arise from Applicant's use or access of them. Applicant's use or access of such Linked Site(s) will be governed by the terms and conditions of use and service contained within each such Linked Site(s).
The access to this Website is granted on a temporary basis, and CKGS, at its sole discretion, reserve the right to withdraw or amend the Services without notice. CKGS will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, CKGS may restrict access to some parts or this entire Website.
Scope of Services
CKGS is the outsourcing partner of the Missions in United States of America for providing the following categories of services singularly or in combination (these will be collectively referred to as "Services").
- Indian Visa;
- OCI Card - (Overseas Citizenship of India);
- PIO Card - (Person of Indian Origin);
- Renunciation of Indian citizenship
For this purpose, CKGS is responsible for scheduling appointments, receipt of complete applications including full fees from the applicant, submission of applications to the Missions in USA, collecting processed passports / documents from the Missions and returning the passports / documents to the Applicants.
It shall be solely the Applicant's responsibility / obligation to provide CKGS with all required duly signed Government forms, letters, forms and documentation as per the Checklist of the relevant service type and category. Checklists are not exhaustive. The Mission may ask for additional documents and payments as stated in CKGS website. Fees, rules and documents are subject to change without any prior notice. Please further note that acceptance of the application by CKGS does not guarantee that such Applicants' information and supporting documents as provided are deemed sufficient.
Applicant must submit / send photocopies of the supporting documents (not originals) unless originals are requested.
Important: Applicant must ensure that they enter their correct & contactable personal details such as email address, mobile number, address (even if the application is filled by themselves or through an authorized Third party agent) on both the CKGS form and the Govt. form at the time of submissions online or offline. Documents will be returned to the address stated on the form. If the Applicant has changed his/her address, then valid proof of new address will be required at the time of submission of the application to CKGS. Do not under any circumstances submit the agents' email address and / or mobile / other number.
CKGS has been authorized by the Government of India for processing Visa, OCI & Renunciation application. Only certain third party agents have been authorized by Government to submit the application on the Applicant's behalf through propriety software. As per the Mission's instructions, if CKGS receives applications through unauthorized travel agents, it may be returned back unprocessed by CKGS. If any application is found to have details of the third party agent masquerading as the Applicant and sending such applications instead of the Applicant; then such applications will be returned unprocessed by CKGS.
In case any applications are being sent by unauthorized agents, the possibility of non-processing lies solely with the Applicant and the said agent.
Whilst CKGS uses reasonable care to check Applicant's application form for obvious errors on the face of the form, CKGS does not guarantee to detect errors within Applicant's form and CKGS does not undertake to verify any information that the Applicant provides, which the Applicant is solely responsible to ensure for accuracy.
It is also the responsibility / liability of the Applicant to carefully check all the information on the Visa / OCI Card / PIO Card / Renunciation such as but not limited to the name, spellings, passport number, type of service and category and validity, etc.
The fees payable by the Applicant are as follows:
Depending on the category selected, the service fees per application are the following:

- Value Added Services like Shipping (optional) [CKGS Fees]
Note: All fees / charges payable are per Applicant.
Please note that the payment for the services must be cleared in full by the Applicant and may be made through Credit Card / Money Order / Pay Order / Cashiers / Bankers Check favouring 'Cox & Kings Global Services USA LLC' (a subsidiary of CKGS). For credit cards, convenience fee is applicable and is non-refundable. Cash payments are not accepted.
Note: Personal Checks and Bank Transfers are not accepted.
Changes to Procedures and fees
Please note that the fees / charges provided will be valid and applicable on the day that they are quoted and provided by CKGS.
CKGS does not accept responsibility for any changes in procedures, rules, documents or fees and reserves the right to pass on any increased fees to the Applicant, if he/she decides to make the application on a later date, and / or if the application is in transit.
A barcode/sticker would be pasted behind all the original passports received along with the application. This is the application procedural requirement as per the norms of the Mission.
Granting / rejection of Services
The decision making of an application rests solely with the Mission. The Mission reserves the right to grant / deny an application without assigning reasons and the decision of the Mission is final and binding upon the Applicant.
Time Limit for Processing
The processing times mentioned for application / s are estimated average processing time only. The processing of an application including the processing time is subject to the procedures and experience of the concerned Mission over which CKGS HAS NO CONTROL. It is subject to change on a case to case basis.
Mission Services Camp
Applications submitted through Mission Services Camp/s must be either in person or through an authorized representative / family member (as long as the representative is not a travel agent) and should be done through "Appointments" only. The mode of return of passport after processing is by shipping only.
CKGS normally communicates with the Applicant through the modes of 'Track and Trace' /and / or Mobile and / or email and / or SMS.
In case of applications received through authorised third party Agents for the Applicant, CKGS will send its communication by email to both the Applicant / Agent to the email IDs provided. The email and mobile number provided on the Government of India online forms must belong to the Applicant and must be contactable in case of any further communication. The Applicants can track the application status on the CKGS website www.in.ckgs.us or by logging onto our mobile application app.in.ckgs.us CKGS bears no responsibility / liability if the Applicant or the third party Agent does not respond to the 'Track and Trace' / Mobile / email / and / or any other communication of CKGS. CKGS will not be responsible if there is no communication / miscommunication / delay in communication by the Agent to the Applicant or vice versa. The responsibility of CKGS ends at the moment it has made such communication to the Applicant / Agent.
Erroneous / Ineligible applications
If errors (such as but not limited to mismatch of name, surnames, date of birth, gender, passport number, place of birth, date of issue and expiry of passport, signatures, photos etc) during application scrutiny by CKGS, then such applications will be marked as "Ineligible" and will be returned by CKGS as per the guidelines prescribed by the Mission. If the application has been received through shipping, it will be shipped back to the Applicant with justification. If the application has been received through walk-in, then the same will be returned back immediately. Refunds will be as per the Refund rules mentioned below.
Upon receipt of the application, if CKGS notices whilst processing the application, that the same is incomplete (i.e. the documents submitted are not as per the checklist which was shared with the Applicant at the time of application) and / or proper payment is not received, then CKGS will put 'On Hold' the processing of such application and send a communication with details about the deficiency ies in the application. The Applicant is required to provide all the necessary documents, full payment / short fall in payments to CKGS within 7 working days from the date such communication is sent by CKGS. Refunds will be as per the Refund rules mentioned below.
Pending Additional Documentation
Similarly, after submission of documentation by CKGS to the Mission, the latter has the right to request for further documentation, supporting documents, correct and missing information on a case to case basis. CKGS will put 'On Hold' the processing of such application and send a communication with details about such additional information / documents and /or may call the applicant for an interview. The Applicant is required to provide all the necessary information / documents to CKGS within 7 working days from the date such communication is sent by CKGS.
In case of Incomplete Documentation & Pending Additional Documentation situations, such application will remain on hold in the CKGS Application Center for a maximum period of 21 calendar days from the date of communication sent to the Applicant, at the Applicant's sole risk and consequences and will be treated as 'Abandoned' if not addressed by the Applicant and will be returned to the Applicant as mentioned below.
If the Agent / Applicant has already paid for a return shipping from CKGS or enclosed his / her own prepaid envelope, the 'Abandoned Application' will be returned to the current address stated on the label. If the Applicant / Agent have not enclosed his / her own prepaid envelope, CKGS will return by Shipment, the 'Abandoned Application' to the current address of the Applicant. If neither the prepaid label nor have the fees been enclosed, then CKGS will consider this application 'Abandoned' and it will be handed over to the Mission of the Applicant's Jurisdiction at the Applicant's own cost, risk and consequences. The Consulate may charge an additional 23 USD per application during collection in such cases. Other Refunds will be processed as per the Refund Rules mentioned above.
If the Applicant wishes to re-apply, the Applicant will have to re-process the full application as a NEW complete application, including all applicable payments.
CKGS TAKES EVERY REASONABLE PRECAUTION WHILE HANDLING AN APPLICANT'S PASSPORT & DOCUMENTS AND IF DUE TO ANY BREACH OF CONTRACT OR NEGLIGENCE ON THE PART OF CKGS, THE APPLICANT'S SUBMITTED PASSPORT OR DOCUMENTS ARE LOST OR DAMAGED BEYOND USEABLE CONDITION WITHIN THE PREMISES OF CKGS, THEN CKGS WILL PAY TO THE APPLICANT THE AMOUNT OF THE FEES CHARGED FOR THE REPLACEMENT OF THE LOST OR DAMAGED PASSPORT OR OTHER DOCUMENTS THROUGH THEIR NORMAL REPLACEMENT PROCEDURE AND CKGS WILL ASSIST THE APPLICANT WITH THE SAME WITHIN ITS CAPACITY. IN CASE OF A LOST / MISPLACED / DAMAGED / STOLEN PASSPORT WITHIN CKGS PREMISES, THEN THE LIABILITY OF CKGS IS LIMITED TO US $ 195 OR THE ACTUAL COST OF REISSUANCE OF PASSPORT WHICHEVER IS LESSER AGAINST PROOF OF RECEIPT.THIS DOES NOT INCLUDE ANY LOST / MISPLACED / DAMAGED / STOLEN PASSPORT OR DOCUMENTS BY THE SHIPPING SERVICE PROVIDER. THE TERMS & CONDITIONS OF THE SHIPPING PROVIDER WILL APPLY IRRESPECTIVE, IF THE SHIPMENT HAS BEEN BOUGHT BY THE APPLICANT THROUGH CKGS OR IF A PREPAID LABEL IS BOUGHT DIRECTLY FROM THE SHIPPING SERVICE PROVIDER BY THE APPLICANT.
Revocation / Cancellation Policy
If the Applicant commences an application process, including by submitting an online application, the Applicant may revoke / cancel / withdraw the application at any time. Depending upon the timing of such request by the Applicant and the stage in which the application is currently; any ONE of the following refund rules shall apply:
RULE 1: Applicant has filled the form online and made the payment and has not yet shipped the application to the (VAC) and the cancellation request is initiated by the Applicant, the refund will be as follows:

- *Convenience charges applicable only for Credit Card payments and are non-refundable.
- Additional charge of 2.00 $ will be levied in case of refunds done through Cheque payment.
- CKGS will not be responsible for any penalty charges levied by the bank in case the Applicant attempts to stop check payment.
- **Shipping charges are non-refundable if Incoming Label (from You to CKGS) is printed or downloaded by you.
- **Shipping charges are non-refundable if the Applicant collects documents directly from the EOI / Consulate or from CKGS Application Center.
- Shipping, Text Services & Other VAS is all optional services.
- Refund processing time will be approximately 15 business days for all except shipping services in which case the tracking status of the generated shipping label should have expired. This might take as long as 45 days in certain cases. The Applicant cannot reuse the Incoming Airway Bill (AWB) of a Cancelled application to send any new application in future.

- Visa issued for lesser duration or lesser number of entries
- ****The Consulate may charge an additional 23 USD per application during collection in such cases.
- Renunciation Penalty is applicable only in case of Renunciation and under specific conditions.
Granting of Visa / OCI / Renunciation is a sovereign right of the nation and CKGS is a mere facilitator in coordinating between the Mission and the Applicant as per requirements. It has NO DECISION making rights or control in grant / denial / delay of Visa / OCI / Renunciation. Hence, NO Refunds will be granted by CKGS under the following circumstances:
- Rejection of Visa / OCI / Renunciation application by the Indian Mission.
- Request for Reapplication of Visa / OCI / Renunciation by Indian Mission.
- Delay in processing Visa / OCI Card / Renunciation application by Mission.
- Non-receipt of Emergency Visa on or before the travel date.
- Non-receipt of Medical / Medical dependent visa leading to further complication and additional medical expenses.
- Loss to Employer / Self due to delay in receipt of Business / Work / Conference / Employment Visa due to nonattendance.
- Loss due to Deportation and repatriation for any reason at the Port of Entry in India.
- Delay in shipping of Visa / OCI / Renunciation / Passport by shipping company.
- Loss or Damage of Visa / OCI / Renunciation / Passport in transit by shipping company.
- Lesser duration or no of entries visa granted by the Mission as compared to the requested entry / duration.
- Change in Visa fee by the Mission.
- Liberalization of Visa policies like No Visa Required.
- Loss to Self / Family / Companion, in case dependent visa gets delayed / rejected by the Indian Mission.
- Air tickets, Hotel booking and other related cancellation due to delay or rejection of Visa / OCI / Renunciation application.
- All expenses related to travel to CKGS VAC to collect Visa / OCI / Renunciation including but not limited to local / Interstate travel expenses, purchase of Food / Beverages, hotel accommodation, boarding/ lodging expenses.
- Opportunity loss for time spent on Visa / OCI / Renunciation application.
Promotional material may follow the relevant documents such as but not limited to passports or other documents at the time they are returned to the Applicant. If the Applicant does not wish to receive this Material, the Applicant must intimate CKGS in advance at the time of submitting the documents. Please note that neither CKGS nor Government of India endorse such promotional material.
EXCLUSION OF LIABILITY
CKGS BEARS NO RESPONSIBILITY / LIABILITY FOR COSTS INCURRED BY THE APPLICANT IN ANTICIPATION OF AN APPLICATION TO BE FINALISED BY THE CONCERNED MISSION. THESE COSTS MAY INCLUDE BUT ARE NOT LIMITED TO AIR TICKETS OR ANY OTHER TRANSPORT COST, ACCOMMODATION, AND / OR ANY OTHER COSTS. CKGS STRONGLY RECOMMENDS THAT THE APPLICANT MUST NOT MAKE ANY TRAVEL BOOKINGS, UNTIL RECEIPT OF POSITIVE CONFIRMATION OF THE APPLICATION FROM MISSION.
CKGS IS NOT RESPONSIBLE / LIABLE FOR LOSS OR DAMAGE WHICH OCCURS DUE TO ANY EVENT OR INCIDENT WHICH HAPPENS OUTSIDE CKGS'S CONTROL (FORCE MAJEURE EVENTS) AND WHICH IS NOT ATTRIBUTABLE TO ANY ACT OR OMISSION BY CKGS.
CKGS WILL NOT BE HELD RESPONSIBLE / LIABLE FOR ANY LOSS OR DAMAGE, DELAYS CAUSED BY MISSION, PROCESSING AN APPLICATION INCORRECTLY, ATTACHMENT OF WRONG PHOTOGRAPHS, DURATION AND TYPE OF VISA (SINGLE / MULTIPLE ENTRY), ISSUING AN INCORRECT OCI CARD, RENUNCIATION OR VISA AND / OR INCORRECT DETAILS MENTIONED ON THEM INTER ALIA DUE TO INCOMPLETE APPLICATION FORMS, INCORRECT OR FALSE INFORMATION ON APPLICATION FORM AND INACCURATE AND INCOMPLETE INFORMATION AND SUPPORTING DOCUMENTS PROVIDED BY THE APPLICANT.
CKGS IS NOT RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE INCIDENTAL, SPECIAL, CONSEQUENTIAL LOSSES & DAMAGES ARISING WHATSOEVER OUT OF THE DELAY, MISPLACEMENT, DAMAGE, NON-DELIVERY OR LOSS OF PASSPORTS, DOCUMENTS OR MONEY.
CKGS IS NOT RESPONSIBLE OR LIABLE FOR ANY CLAIMS THAT MAY ARISE DUE TO CHANGE IN ADDRESS OF THE APPLICANT FOR THE RETURN SHIPPING, CKGS IS NOT LIABLE / RESPONSIBLE FOR THE WRONG ADDRESS / CONTACT DETAILS MENTIONED BY THE APPLICANT IN HIS / HER APPLICATION / DOCUMENTS AND / OR LABEL INCLUDING PREPAID SHIPPING. APPLICANT WILL HAVE TO BEAR THE SHIPPING CHARGES FOR ANY VERIFICATION / DELIVERY.
CKGS IS NOT RESPONSIBLE OR LIABLE FOR ANY CLAIMS THAT MAY ARISE IF THE APPLICATION IS RETURNED UNPROCESSED DUE TO NONCOMPLIANCE BY THIRD PARTY AGENTS WITH REFERENCE TO INCORRECT UPDATION OF APPLICANT'S DETAILS SUCH AS ADDRESS, PHONE NUMBER AND EMAIL ID.
CKGS IS NOT LIABLE / RESPONSIBLE TO THE APPLICANT AND / OR THE THIRD PARTY AGENTS IF THEY DO NOT FOLLOW THE COMMUNICATION POLICY MENTIONED HEREINABOVE.
IN CASE OF A LOST / MISPLACED / DAMAGED / STOLEN PASSPORT WITHIN CKGS PREMISES, THE LIABILITY OF CKGS IS LIMITED TO US $ 195 OR THE ACTUAL COST OF REISSUANCE OF PASSPORT THROUGH NORMAL REPLACEMENT PROCEDURE WHICHEVER IS LESSER AGAINST PROOF OF RECEIPT. THE AMOUNT IS BASED ON US STATE GOVERNMENT'S WEBSITE INFORMATION. CKGS SHALL NOT BE HELD RESPONSIBLE / LIABLE FOR ANY FINANCIAL CHARGES OR LOSS / DAMAGE OF ANY KIND WHATSOEVER. FURTHER NO OTHER COSTS OF AIR TICKETS, TRANSPORT, and ACCOMMODATION STAY OR ANY OTHER COSTS SHALL BE PAID / REFUNDED.
CKGS always uses the services of shipment service companies for the purpose of transmission of passports and documents. Their respective terms & conditions shall apply in addition to these Terms & Conditions even if the shipping labels are purchased by the Applicant from CKGS. CKGS shall not be held responsible/liable for any claims from Applicants for non-receipt of the documents by CKGS arising due to any reason attributable to the shipment service companies. CKGS will not be responsible / liable for any loss or damage whether direct, indirect, incidental or consequential, caused due to transmission delays or loss or damages of passport or documents, delivering the documents to the wrong address either to CKGS or in the course of transmission of documents by CKGS to the Applicant.
This applies also in the course of transmission of documents by CKGS to the Mission and back from the Mission to CKGS. CKGS would however, make best attempts to trace the Applicants' documents or assist the Applicant in obtaining alternative / certified copies of the lost documents.
Should the Applicant decide to avail the return shipping facility from CKGS, the documents will be returned only to the registered present address or permanent address as specified in the shipping address proof submitted by the Applicant.
In case of a change of address for the return shipping, CKGS will be unable to assist with this change request and does not take any liability / responsibility for such claims that may arise.
Note: In case of applications received through third party Agents for the Applicant, CKGS will send the shipment to the registered present address or permanent address as specified in the shipping address proof submitted by the Applicant ONLY. In case the return shipping address is found to the third party agent's address, then such applications will be returned unprocessed as per instructions from Mission.
Shipping Policy for Prepaid Labels Bought Directly by Applicants from Shipping Service Provider
If the Applicant has submitted a Prepaid Envelope / Shipping Label along with the application, CKGS cannot take any responsibility of pick-up and delivery to the Applicant. The Shipping Service Providers often do not acknowledge receipt of envelopes. Nor will CKGS drop off the Applicant's prepaid envelopes to their Shipping Service Provider as the Applicant has not bought the shipping service from CKGS.
FedEx & USPS Prepaid Envelopes sent by the Applicant are NOT accepted. Handwritten Envelope / Labels sent by the applicant are also NOT accepted. For prepaid labels, CKGS will not be liable / responsible to contact the Applicant and if the Applicant ignores this point, for any delay / rejection occurring will be Applicant's liability / responsibility.
The applicant needs to provide the Airway Bill (AWB) Number and Service provider's details when prompted at the Shipping stage during online application or in "My Account" on the CKGS website. CKGS does not take any responsibility of pick-up and delivery to me. Shipping Service providers often do not acknowledge receipt of the envelopes nor will CKGS drop off my prepaid envelopes to the said shipping service provider as the shipping service has not been purchased from CKGS.
CKGS offers "Standard Overnight Service" for FEDEX and "Next Day Air" for UPS to applicants without signature and without standard insurance. Applicants are free to opt for insurance / signature services of their choice.
Rescheduling or cancellation of confirmed appointment is allowed up to forty eight (48) hours prior to the scheduled date of appointment. CKGS service fee will not be refunded if appointment is not cancelled or applicant is unable to honor the appointment.
If applicants do not appear on the given appointment date, their application will be put on Hold and Applicant No Show fee of USD 19.90 for Visa applications and USD 17 for OCI and Renunciation applications will be levied in addition to total application fees.
The Agent / Applicants agree to allow CKGS at its sole discretion to use any of their, comments, reviews related to CKGS Services made available in the public domain and / or through private communication such as emails, letters etc. and distribute such contents in any of their documents, any promotional materials, websites and any type of media.
CKGS reserves its absolute rights to alter these Terms and Conditions and / or any other documents any time without advance notice and without offering any reason.
As to the interpretation of the foregoing, the decision of CKGS shall be final and binding upon the Applicant.
